Several States Act While FDA Continues to Delay on Plan B Decision
Wisconsin Attorney General Peg Lautenschlager has been given state approval to sue the Food and Drug Administration over its delay on approving the emergency contraceptive known as Plan B for over the counter sale.
Meanwhile, both California and Massachusetts are poised to enact laws that will allow pharmacists to dispense Plan B without a prescription. In an effort to stop pharmacists from refusing to fill prescriptions, Illinois already has a law requiring pharmacists to prescribe Plan B regardless of "moral objections".
Still the FDA is silent, and in the face of resignations, and even internal government reports questioning the motives behind the delay, over-the-counter access to Plan B remains in limbo.
